These Terms of Service ("Terms") govern your use of the Travel Echo mobile app ("App") and any services provided by Travel Echo ("Company"). By accessing or using the App and Company services, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use the App or Company services.
In order to access certain features of the App or Company services, you may be required to create an account. You must provide accurate and complete information when registering for an account. You are solely responsible for maintaining the confidentiality of your account credentials and for any activity that occurs under your account.
You agree to notify Travel Echo immediately of any unauthorized use of your account or any other breach of security. Travel Echo will not be liable for any loss or damage arising from your failure to protect your account credentials.
The App may allow you to submit, send or receive content. You retain ownership of any intellectual property rights that you hold in that content. In short, what belongs to you stays yours.
When you submit, send or receive content to or through the App, you give us (and those we work with) a worldwide license to use, host, store, reproduce, modify, create derivative works (such as those resulting from translations, adaptations or other changes we make so that your content works better with the App), communicate, publish, publicly perform, publicly display and distribute such content. The rights you grant in this license are for the limited purpose of operating, promoting, and improving our App, and to develop new ones. Make sure you have the necessary rights to grant us this license for any content that you submit to our Apps.
You understand that all information, data, text, software, music, sound, photographs, graphics, video, messages, tags, or other materials ("Content"), whether publicly posted or privately transmitted, are the sole responsibility of the person from whom such Content originated. This means that you, and not Travel Echo, are entirely responsible for all Content that you upload, post, email, transmit or otherwise make available via the App. Travel Echo does not control the Content posted via the App and, as such, does not guarantee the accuracy, integrity or quality of such Content. You understand that by using the App, you may be exposed to Content that is offensive, indecent or objectionable. Under no circumstances will Travel Echo be liable in any way for any Content, including, but not limited to, any errors or omissions in any Content, or any loss or damage of any kind incurred as a result of the use of any Content posted, emailed, transmitted or otherwise made available via the App.
You agree that you must evaluate, and bear all risks associated with, the use of any Content, including any reliance on the accuracy, completeness, or usefulness of such Content. In this regard, you acknowledge that you may not rely on any Content created by the App or submitted to the App.
You acknowledge and agree that Travel Echo may preserve Content and may also disclose Content if required to do so by law.
The App and Company services, including all content, features, and functionality, are owned by Travel Echo and are protected by copyright, trademark, and other intellectual property laws. You may not modify, reproduce, distribute, or create derivative works based on any part of the App or Company services without the prior written consent of Travel Echo. Any attempts to reverse engineer, copy, reproduce, or otherwise steal intellectual property from the App will not be tolerated and may result in legal action.
You agree not to engage in any of the following prohibited activities:
The App and Company services are provided on an "as is" and "as available" basis, without any warranties of any kind, either express or implied. Travel Echo does not warrant that the App or Company services will be uninterrupted, error-free, secure, or free from viruses or other harmful components.
Travel Echo disclaims all warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. Any reliance you place on the App or Company services is at your own risk.
To the maximum extent permitted by law, Travel Echo and its officers, directors, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to damages for loss of profits, goodwill, use, data, or other intangible losses, arising out of or in connection with your use of the App or Company services.
In no event shall Travel Echo's total liability to you for all claims arising out of or in connection with these Terms exceed the amount paid by you, if any, for accessing the App or using the Company services during the twelve (12) months prior to the claim.
You agree to indemnify and hold Travel Echo and its officers, directors, employees, agents, and affiliates harmless from any claims, liabilities, damages, losses, costs, or expenses, including reasonable attorneys' fees, arising out of or in connection with your use of the App or Company services, your violation of these Terms, or your violation of any rights of another party.
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction where Travel Echo is located, without regard to its conflict of laws principles.
Any legal action or proceeding arising out of or in connection with these Terms shall be brought exclusively in the courts of the jurisdiction where Travel Echo is located, and you consent to the personal jurisdiction of such courts.
Travel Echo reserves the right to modify or replace these Terms at any time, in its sole discretion. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
By continuing to access or use the App or Company services after any revisions become effective, you agree to be bound by the revised Terms. If you do not agree to the new Terms, you must stop using the App and Company services.
